General Terms of Sale

Article 1. Purpose and Scope

These General Terms and Conditions of Sale (hereinafter "GTC") govern all product sales made by Days Edits, private seller, whose residence is located at 70 Rue Ruinart de Brimont, 51100 Reims, France, reachable by email at megad6222@gmail.com (hereinafter "the Seller"), to any consumer or non-professional (hereinafter "the Customer") placing an order on the online store hosted by Shopify Inc., 151 O'Connor Street, Ottawa, Ontario K2P 2L8, Canada, accessible under the domain 07qtch-st.myshopify.com.

Any order placed on the store implies full and unconditional acceptance of these GTC. These GTC prevail over any other Customer document. The Seller reserves the right to modify these GTC at any time; the applicable version is the one in effect on the day of the order.

Article 2. Pre-contractual Information (Art. L.221-5 Consumer Code)

In accordance with Article L.221-5 of the Consumer Code, the Customer acknowledges having received, in a clear and understandable manner, before placing the order, the following information:

  • The essential characteristics of the product;
  • The total price including tax of the product and delivery fees;
  • The estimated delivery date or timeframe;
  • Information regarding the Seller’s identity, postal and electronic contact details;
  • Payment, delivery, and execution terms;
  • The existence and conditions for exercising the right of withdrawal;
  • The duration of the contract and termination conditions;
  • Applicable legal warranties.

Article 3. Product Description and Warning

The Seller offers for sale the Lumina Glow 4.0, a 7-in-1 LED photobiomodulation personal care device. Descriptions, photographs, and technical specifications on the site are provided for informational purposes only and may be updated without notice.

Important Warning: The Lumina Glow 4.0 is a wellness device intended for personal cosmetic use. It is not a medical device within the meaning of Regulation (EU) 2017/745 on medical devices. It is not intended to diagnose, prevent, monitor, treat, or alleviate any disease or pathological condition. Results are individual and may vary from person to person. The use of this device does not in any way replace medical advice or consultation with a healthcare professional.

Contraindications: It is not recommended to use the device in the following cases:

  • Pregnancy or breastfeeding;
  • Photosensitive epilepsy or any neurological condition sensitive to light;
  • Use of photosensitizing medications or topical products (tetracyclines, retinoids, certain NSAIDs);
  • Active skin diseases on the treated area (psoriasis, eczema, lupus, progressive rosacea);
  • Skin cancer or history of melanoma;
  • Open wounds or unhealed injuries on the treated area.

Use around the eyes requires wearing the protective glasses provided with the device. Do not direct the LEDs directly at the eyes.

Article 4. Prices

Prices are indicated in euros, all taxes included (TTC), with the application of the current VAT rate of 20% for mainland France. The Seller reserves the right to change prices at any time. Products are billed at the price in effect at the time of order validation. Delivery charges are specified in Article 8 of these Terms and Conditions.

Article 5. Orders and confirmation

The Customer places an order online through the following process: product selection, adding to cart, entering delivery and billing information, choosing the payment method, reviewing the summary, and final validation. The sale is considered concluded at the time of payment validation. A confirmation email summarizing the essential elements of the order (reference, products, price, address, estimated delivery time) is sent to the Customer as soon as possible. The Seller reserves the right to refuse or cancel any order for legitimate reasons, notably in case of availability issues or previous disputes.

Article 6. Payment

Payment is made online, securely, via Shopify Payments (Stripe), accepting major credit cards (Visa, Mastercard, American Express). Payment is due in full at the time of order. No banking data is stored by the Seller; this data is processed directly and encrypted by the payment provider.

Article 7. Right of withdrawal (art. L.221-18 Consumer Code)

In accordance with Article L.221-18 of the Consumer Code, the Customer has a period of fourteen (14) calendar days from the receipt of the product to exercise their right of withdrawal, without having to justify any reason or pay any penalties.

Procedure: To exercise this right, the Customer must notify the Seller by email at megad6222@gmail.com, providing their contact details, order number, and, if applicable, using the standard withdrawal form provided in Article L.221-5 of the Consumer Code. The product must be returned to the Seller in its original packaging, complete and in perfect condition, within fourteen (14) days following the withdrawal notification. Return costs are the responsibility of the Customer, except if the product is defective or non-compliant. The refund of the purchase price will be made within fourteen (14) days from receipt of the returned product, using the same payment method as used for the order.

Article 8. Commercial guarantee "Satisfied or Refunded" 28 days

In addition to the legal 14-day withdrawal right, the Seller grants the Customer a commercial "Satisfied or Refunded" guarantee extending the return period to twenty-eight (28) calendar days from receipt of the product. This commercial guarantee is exercised under the same conditions as the legal withdrawal right described in Article 7. It does not reduce or replace the Customer's legal rights.

Article 9. Delivery

Orders are shipped within mainland France by Colissimo or DPD within 3 to 5 business days from payment confirmation. Delivery is free for all orders placed in the store. A tracking number is provided by email as soon as the shipment is made. In case of delay, loss, or damage observed upon delivery, the Customer must make reservations with the carrier at the time of receipt and contact the Seller at megad6222@gmail.com as soon as possible.

Article 10. Legal guarantee of conformity (art. L.217-4 and following Consumer Code)

The Seller is bound by the legal guarantee of conformity provided for in Articles L.217-4 and following of the Consumer Code. In case of non-conformity, the Customer has a period of two (2) years from the delivery of the goods to take action. The Customer may choose between repair or replacement of the goods, subject to the cost conditions provided in Article L.217-9 of the Consumer Code. The legal guarantee of conformity applies independently of any commercial warranty that may be granted.

Article 11. Legal warranty for hidden defects (art. 1641 Civil Code)

In accordance with Article 1641 of the Civil Code, the Seller is liable for hidden defects of the sold item that make it unfit for the intended use, or that so diminish this use that the buyer would not have acquired it, or would have paid a lower price, had they known of them. The warranty action must be brought within two years from the discovery of the defect.

Article 12. Limitation of liability

The Seller cannot be held responsible for indirect damages resulting from the use of the product, notably in case of non-compliance with instructions, failure to respect the contraindications mentioned in Article 3, or pre-existing medical conditions of the Client. Results obtained with the Lumina Glow 4.0 are individual and variable; no specific result is guaranteed. The use of the device does not replace professional medical advice or monitoring.

Article 13. Intellectual property

All elements of the online store (texts, photographs, visuals, logos, brands) are the exclusive property of Days Edits or are subject to an authorization for use. Any reproduction, representation, modification, or exploitation, in whole or in part, without prior written authorization from the Seller, is strictly prohibited and constitutes an infringement punishable under the Intellectual Property Code.

Article 14. Consumer dispute mediation

In accordance with the provisions of the Consumer Code relating to amicable dispute resolution and Directive 2013/11/EU, the Client may, in case of an unresolved dispute, use a consumer mediator free of charge. The Seller adheres to the CNPM mediation service (National Center for Mediation and Prevention), reachable at: 27 avenue de la Libération, 42400 Saint-Chamond, and on the website www.cnpm-mediation-consommation.eu. The European online dispute resolution platform is accessible at ec.europa.eu/consumers/odr.

Article 15. Applicable law and competent jurisdiction

These GTC are subject to French law. In case of dispute, the parties will strive to find an amicable solution. Failing an agreement, any dispute relating to the formation, interpretation, or execution of these GTC will be brought before the competent courts of Reims, unless otherwise provided by mandatory legal provisions applicable to the consumer.
